Oh So Soft Play AU PTY LTD - Terms & Conditions

1. Agreement to Terms

By submitting a booking form and completing payment, the hirer acknowledges and agrees to all the terms and conditions outlined herein.

2. Health and Safety

i. Oh So Soft Play AU PTY LTD maintains Public Liability Insurance; however, the hirer assumes responsibility for any damage or injury resulting from misuse or negligence during the rental period. It is the hirer's duty to ensure all individuals adhere to safety guidelines while using the equipment.

ii. All equipment use must be supervised by a responsible adult. The hirer must ensure all parents, caregivers, or adults present understand the necessity of continuous supervision to prevent accidents.

iii. The event supervisor must be a responsible individual over 18 years old and must not be under the influence of alcohol. Oh So Soft Play AU does not provide supervision during the rental period unless specifically arranged and paid for in advance.

iv. Children aged 0-5 years may use the soft play equipment under adult supervision. The maximum weight limit for equipment use is 40kg.

v. The hirer agrees not to rearrange the equipment, as it may lead to injuries or damages. Photographs will be taken after setup as evidence of the equipment's original configuration.

vi. The equipment will be thoroughly cleaned and sanitised before each event. Children displaying symptoms of illness or with open wounds should not use the equipment to prevent the spread of infection.

vii. The ball pit is not suitable for children under 2 years old. It will not be filled to capacity to prevent suffocation or injury, especially to younger children.

viii. Providing shade for outdoor events, particularly during warmer months, is advisable to prevent burns from hot surfaces.

ix. The hirer agrees to use the equipment only for its intended purpose and in suitable locations, as determined by Oh So Soft Play AU PTY LTD.

x. Ball Pit balls are to be returned to the ball pit before the equipment is picked up.

3. Hire of Soft Play Equipment and Fees

i. Prices are subject to change, but once a booking is confirmed, the quoted price remains unchanged.

ii. Bookings are secured upon submission of non-refundable deposit.
iii. The remaining balance must be paid at least 7 days before the event.

iv. A high-risk delivery fee of $50 may apply to locations with stairs or setups over 50 metres from the delivery vehicle. This fee will be included in the invoice and must be paid 7 days before the event.

4. Booking Changes and Cancellations

i. Booking changes are subject to Oh So Soft Play's discretion and availability.

ii. Cancellations made within 7 days of the event will result in forfeiture of the non-refundable deposit. Cancellations made more than 7 days in advance will receive a credit for the deposit amount, valid for one year and subject to availability.

iii. Cancellations made more than 4 weeks before the event will receive a full refund of the deposit.

iv. In case of cancellation due to bad weather, rebooking is allowed within 12 months of the cancellation date.

v. Failure to pay the balance hire fee and bond within 7 days before the event will result in automatic cancellation of the booking, with forfeiture of any deposit.

vi. Bookings made less than 7 days before the event require payment in full within 24 hours.

5. Booking Form

i. All Equipment hire requests must be completed on the agreed booking form and sent to the Owner for

confirmation that the Equipment will be available on the day of hire.

ii. The booking is not confirmed until Oh So Soft Play AU PTY LTD has confirmed it with the hirer.

6. Damages and Bond

i. Any damage to the equipment must be reported promptly to Oh So Soft Play AU PTY LTD.

ii. The hirer is responsible for the cost of repairing any damage to the equipment during the hire period, excluding normal wear and tear.

iii. A bond of $100 is required when confirming booking. This amount will be returned to the hirer the day after the event if the equipment is deemed as returned in good condition.

7. Delivery and Setup

i. Setup requires 1-2 hours before the event and dismantling, cleaning, and equipment collection require 1-2 hours after the event.

ii. The hirer is responsible for ensuring venue access for equipment setup and collection.

iii. The equipment must be placed on a level surface, away from hazards such as rocks, sharp objects, and water.

iv. The hirer must ensure adequate space for the soft play setup and necessary clearance area around it. Adjustments may be made if space is insufficient, with no change in fees.

8. End of Hire

i. The hirer must ensure the equipment is clean and tidy for collection to avoid a cleaning fee.

ii. The hirer must ensure all ball pit balls are returned to the ball pit before equipment is picked up.

9. Insurance

i. Oh So Soft Play AU PTY LTD maintains insurance policies covering the equipment's full insurable value.

10. Liability and Indemnity

i. Oh So Soft Play AU PTY LTD’s liability is limited to the extent permitted by law.

ii. The hirer acknowledges the potential for injury during equipment use and releases Oh So Soft Play from any related claims.

11. Governing Law and Jurisdiction

This agreement is governed by the laws of New South Wales.

Oh So Soft Play AU Rules of Play

- Children must be supervised by an adult at all times.
- Soft play equipment is intended for children aged 0-5 years only.
- Acrobatics or gymnastics activities are not permitted.
- Food, drinks, sharp objects, face paint and glitters are not allowed in the play area. - Shoes must be removed, and socks must be worn. Strictly NO high heels.
- Pets are not allowed near the play equipment.
